How does my client's organization register as a charity with the CRA, and how long does it take?
To register a charity in Canada in 2026, your client sets up a corporation, trust or constitution with exclusively charitable purposes, gets a business number and RR account, then applies online through My Business Account with certified governing documents. The CRA aims to decide within nine months of receiving a complete application, 80% of the time.
What are the steps to register a charity in 2026?
The CRA splits the process into four steps: decide whether to apply, set up the organization, apply, then go through the review canada.ca. In practice your client works through it in this order.
| Step | What your client does | The rule behind it |
|---|---|---|
| 1. Check eligibility | Confirm every purpose fits one of the four categories of charity and benefits the public | Purposes must be exclusively charitable |
| 2. Create the legal entity | Incorporate, or sign a constitution or trust document, with charitable purposes in it | The CRA won't review draft governing documents |
| 3. Get a BN and RR account | Register through Business Registration Online, then add the BN to a CRA business account | A BN and RR account don't grant registration on their own |
| 4. Apply online | Complete the application in My Business Account and upload every mandatory document | The form won't submit until all mandatory items are in |
| 5. Answer the CRA | Respond to any request for more information | Generally 60 days to respond |
| 6. Receive the notice of registration | Keep it safe: it shows the registration number and effective date | Only then can receipts be issued |
The four categories are relief of poverty, advancement of education, advancement of religion, and other purposes the courts have recognized as beneficial to the community, and the beneficiaries must be the public or a significant section of it, not a social club or professional association canada.ca. Under ITA 248(1), a registered charity must also be resident in Canada and created or established in Canada
laws-lois.justice.gc.ca.
For step 3, the CRA asks for a CRA account first, then a BN and RR program account through Business Registration Online if the organization doesn't already have them, and warns that the RR account alone doesn't make the organization a registered charity canada.ca. The business number registration page covers BRO in detail. The online application has replaced Form T2050 since June 2019
canada.ca.
What does the online application need from your client?
You can file it yourself as an authorized representative through Represent a Client, or the organization's own people can sign in to My Business Account and take turns completing sections. The form can be saved and reopened, and it only submits once every mandatory question is answered and every mandatory document uploaded canada.ca.
| Upload | What the CRA wants |
|---|---|
| Certified governing documents, with bylaws and amendments | Incorporated: an effective date and the incorporating authority's stamp or signature. Constitution: signed by at least three current directors, with an effective date. Trust: signed by at least one trustee, with an effective date |
| Certificate of good standing | Only if incorporated five years or more, or incorporated and applying again |
| Financial statements | The latest ones, if the organization has operated, plus the financial section of the form |
| Description of activities | Detailed enough to show each activity is charitable and furthers a stated purpose |
| Agreements with intermediaries | Contracts with anyone carrying out activities for the organization, inside or outside Canada |
| Directors list | Every director, trustee or like official, with address, phone number and date of birth |
The CRA publishes the requirements as an upload list at the end of the form canada.ca, and an interactive checklist adds conditional items when the organization works through intermediaries, operates outside Canada, runs fundraising events, hires a fundraising company or owns land or buildings
canada.ca.
Draft documents stop the file cold: the Charities Directorate will not review an application submitted with draft governing documents, and it recommends incorporation if the organization owns or plans to own land or buildings canada.ca.
How long does the CRA take to decide?
For 2026 to 2027, the CRA's service standard is a final decision within nine months of receiving a complete application, met 80% of the time, with applications generally handled first come, first served canada.ca. The clock starts at complete. An incomplete application is rejected and returned, and a complete one gets an acknowledgement letter before an officer is assigned
canada.ca.
If the officer asks for more information, your client generally has 60 days to respond. No response means the file is treated as abandoned and closed without further notice, with no right of appeal, so the only route is a fresh application. A refusal comes by letter, and a notice of objection is due within 90 days of the day it was mailed canada.ca.
| Outcome, 2024 to 2025 | Share of charity applications |
|---|---|
| Approved | 82% |
| Abandoned | 9% |
| Withdrawn | 4.05% |
| Returned incomplete | 4.4% |
| Denied | 0.55% |
The CRA received 2,720 charity applications that year, and 36% of all applications were incomplete when submitted canada.ca. Abandonment, not refusal, is the bigger risk.
Worked example: the CRA receives your client's complete application on February 2, 2026. Nine months later is November 2, 2026, the date the standard aims to beat in 80% of files. If the officer writes on June 15, 2026, the reply is generally due 60 days later: 15 days to June 30, 31 more to July 31, and 14 more to August 14, 2026. Calendar that date the day the letter arrives.
Which designation will the CRA give your client?
The CRA assigns one of three designations based on structure, funding and how the charity operates, and states it in the notice of registration canada.ca.
| Designation | Structure | How it operates | Control test |
|---|---|---|---|
| Charitable organization | Corporation, trust or constitution | Mainly carries on its own charitable activities | More than half the directors at arm's length, funding from a range of arm's length donors |
| Public foundation | Corporation or trust | Generally gives more than 50% of its income each year to other qualified donees | More than half the directors at arm's length |
| Private foundation | Corporation or trust | Its own activities, grants to qualified donees, or both | Half or more of the directors not at arm's length, or more than 50% of funding from a person or group that controls it |
A charity with only one director, trustee or official is automatically designated a private foundation on registration, because it can't meet the arm's length test canada.ca. The same 50% arm's length rule sits in the charitable organization definition in ITA 149.1(1)
laws-lois.justice.gc.ca. A founding family that wants charitable organization status needs independent directors before it applies.
What does your client owe the CRA once it is registered?
Registration lets the charity issue official donation receipts, exempts it from income tax, lets it receive gifts from other registered charities and exempts many of its supplies from GST/HST. In return it must devote its resources to its charitable purposes, keep direction and control over them, file the T3010 within six months of its fiscal year end, meet the disbursement quota, keep books and records, issue accurate receipts, stay a Canadian legal entity and tell the Charities Directorate about changes to its operations or structure canada.ca.
The T3010 is due without notice or demand under ITA 149.1(14) laws-lois.justice.gc.ca. A charity registered in November 2026 with a December 31 year end files its first return by June 30, 2027. The revocation clock for a late return is on the T3010 filing deadline page, and receipt content is on the official donation receipt requirements page.
The disbursement quota applies once the 24 month average of property not used in charitable activities or administration tops $100,000 for a charitable organization or $25,000 for a foundation: 3.5% of that average up to $1 million, plus 5% of the excess canada.ca. For a charitable organization averaging $1,400,000 of investments, that's $35,000 (3.5% of $1,000,000) plus $20,000 (5% of $400,000), a quota of $55,000.
Records have their own clocks: duplicate receipts for two years from the end of the calendar year of the gift, the general ledger, financial statements and T3010s for six years from the end of the fiscal year they cover, and governing documents and minutes indefinitely, all at the Canadian address on file canada.ca.
What gets an application refused or sent back?
Vague purposes are the most common drafting problem. The CRA says purposes that are too broad or vague are not charitable, and wants each one to state what benefit it gives, how the organization delivers it and who can receive it. It flags verbs like facilitate, support, assist or coordinate, and words like deserving, worthy or good causes canada.ca. Its own example: "To relieve poverty by providing basic amenities to unhoused individuals."
The CRA lists the factors that block registration outright: being established and resident outside Canada, a profit purpose, income available to members, directors or trustees, benefit to a particular individual or private group, any support for or opposition to a political party or candidate, being created primarily to run a commercial business, and illegal activity or activity contrary to public policy canada.ca. An organization that fails these tests may still qualify as a non profit organization, which is tax exempt but can't issue receipts.

Can the registration be backdated to cover earlier donations?
Only within limits. Under policy CPS-017, the effective date must fall in a period when the organization was operating as charitable, and it can't be earlier than the latest of the incorporation (or inception) date, the last change that made it charitable, and the application date. Any T3010s already due for the period must be filed first canada.ca.
Can my client still mail a paper T2050?
What happens if my client misses the 60 day reply window?
The CRA treats the application as abandoned and closes the file without further notice. Because it was never formally denied, there's no objection or appeal, and your client has to submit a new application with all the documents again canada.ca.
Can a charity with a single director register?
Yes, but it is automatically designated a private foundation, because one director can't satisfy the rule that more than half the directors deal at arm's length canada.ca. Add independent directors before applying if your client wants charitable organization status.
