When is the T5013 partnership information return due, and which partnerships have to file one?
For a December 31, 2025 year end, the T5013 is due March 31, 2026 when every partner is an individual or trust, or when partners are mixed. When every partner is a corporation, it's due five months after year end, which moves May 31, 2026 (a Sunday) to June 1. Slips go to partners by the same date.
When is the T5013 due for each partner mix?
The due date depends on who the partners are, under Regulation 229(5) of the Income Tax Regulations laws-lois.justice.gc.ca. The CRA treats a trust as an individual for this test, and when the date falls on a weekend or a public holiday the CRA recognizes, the return is due the next business day
canada.ca.
| Partners throughout the fiscal period | Rule | December 31, 2025 year end | December 31, 2026 year end |
|---|---|---|---|
| All individuals (trusts count as individuals) | March 31 of the next calendar year | March 31, 2026 | March 31, 2027 |
| All corporations | 5 months after the fiscal period ends | June 1, 2026 (May 31 is a Sunday) | May 31, 2027 |
| Any mix of individuals, trusts and corporations | The earlier of the two dates | March 31, 2026 | March 31, 2027 |
| Partnership discontinued its business | The earlier of 90 days after it stopped and the normal date | Depends on the stop date | Depends on the stop date |
The T5013 slips have the same deadline: you must mail, deliver or send them to the partners no later than the day the return is due, and sending them electronically needs each partner's written or email consent canada.ca.
Which partnerships have to file a T5013?
A partnership that carries on business in Canada, or a Canadian partnership, files when it meets any one of the tests below canada.ca. Legally the obligation sits on each member, but one member's return counts as filed by every member
laws-lois.justice.gc.ca.
| Test | When it is measured | Triggers a filing when |
|---|---|---|
| Revenues plus expenses | End of the fiscal period | The absolute value of revenues plus the absolute value of expenses is more than $2 million |
| Assets | End of the fiscal period | Assets at cost, before depreciation, are more than $5 million |
| Tiered partnership | Any time in the period | The partnership is part of a tiered structure |
| Corporate or trust partner | Any time in the period | A corporation or a trust is a partner |
| Flow through shares | Any time in the period | It invested in flow through shares of a principal business corporation that renounced Canadian resource expenses to it |
| CRA request | Any time | The CRA asks for the return in writing |
A small partnership of individuals that trips none of these tests doesn't file a T5013. Each partner still reports their share of income or loss on their own return canada.ca. The CRA also lists administrative exceptions, including partnerships whose members are all registered or entitled to be registered under the Indian Act and that earn all their income at a permanent establishment on a reserve
canada.ca.
What are the penalties for filing late?
The partnership pays the greater of $100 and $25 a day for up to 100 days, so the penalty tops out at $2,500 per return under s. 162(7.1) of the Income Tax Act laws-lois.justice.gc.ca. The CRA applies the same $25 a day, $100 minimum and $2,500 maximum to each failure, including slips handed out late
canada.ca.
| Failure | Penalty | Authority |
|---|---|---|
| Return filed late | Greater of $100 and $25 a day, maximum 100 days ($2,500) | s. 162(7.1) |
| Repeated failure | Extra $100 per partner for each month or part month, maximum 24 months | s. 162(8) |
| Missing SIN or business number | $100 for each failure | s. 162(5) and (6) |
| Paper filing when internet filing is mandatory | $125 for 6 to 50 slips, rising to $2,500 for 2,501 or more | T4068 |
The repeated failure penalty needs three things together: a 162(7.1) penalty for this fiscal period, a demand for the return served under s. 233 on a partner, and another 162(7.1) penalty in any of the three preceding fiscal periods laws-lois.justice.gc.ca.
Worked example: a partnership of six individuals with a December 31, 2025 year end was due March 31, 2026. Filed May 10, 2026, it is 40 days late (30 days in April plus 10 in May), so the penalty is 40 × $25 = $1,000. Filed on or after July 9, 2026, the 100 day cap applies and the penalty is $2,500. If the 162(8) conditions are also met and the return goes in on August 10, 2026, add 6 partners × $100 × 5 months (April through the part of August) = $3,000, for $5,500 in total.
What changes the date in practice?
Most partnerships with an individual member file on March 31 because their year end is December 31. Under s. 249.1(1)(b), a partnership that has an individual, a professional corporation or another such partnership as a member generally can't have a fiscal period that ends after the end of the calendar year it began in laws-lois.justice.gc.ca.
A partnership whose partners are all ordinary corporations can pick another year end, and its deadline moves with it. A June 30, 2026 year end puts the T5013 at November 30, 2026. Add a professional corporation as a partner and the December 31 rule comes back.
When a partnership stops carrying on its business or activity, every unfiled return is due by the earlier of 90 days after the discontinuance and the normal due date under Regulation 229(6) laws-lois.justice.gc.ca. Diarize the 90 days at the wind up meeting, not at the usual filing season. For the corporate side of a wind up, see T2 filing after dissolution.
What about farm partnerships, internet filing and foreign property?
Farm partnerships made up only of individuals who file T1 returns don't have to file a T5013 for the 2025 fiscal period. A farm partnership with a trust or a corporation as a partner still has to file canada.ca. The CRA page speaks only to 2025, so check it again before you rely on the exemption for a 2026 fiscal period.
Filing over the internet is mandatory if you file more than five T5013 slips for a calendar year, and the 2025 guide says internet filing opens January 12, 2026 canada.ca. The CRA lists the filing methods and amended return options on its electronic filing page
canada.ca.
A nominee or agent holding a partnership interest for someone else has its own information return obligation for that interest under Regulation 229(3). A partnership that holds foreign property may also owe a T1135, a separate return that is due on the same date as the T5013 under s. 233.3(3)(a) of the Income Tax Act.

Does a partnership with a corporate partner and an individual partner get five months?
No. With any individual or trust in the mix, the return is due on the earlier of March 31 and five months after year end, which for a December 31 year end is March 31 laws-lois.justice.gc.ca.
Is the T5013 slip deadline different from the return deadline?
No. Slips must reach the partners no later than the day the return is due, and late slips can draw the same $25 a day penalty, capped at $2,500 canada.ca.
Does a two person partnership with $300,000 of revenue have to file?
Only if it meets another test. Two individual partners, revenues plus expenses under $2 million, assets under $5 million, no tiered structure, no flow through shares and no CRA request means no T5013, though both partners still report their share on their own returns canada.ca.
Does a retired partner with no allocation need a T5013 slip?
No slip is needed when no amount is allocated to that partner, but you still have to tell the partner, and they stay on Schedule 50 for the year canada.ca. Count only the slips you issue on line 073 of the T5013 FIN.
