What is a graduated rate estate, and what does the estate gain by qualifying?
A graduated rate estate (GRE) is a deceased person's estate taxed at the individual graduated rates, 14% to 33% federally for 2026, instead of a flat 33%, for up to 36 months after death. It must designate itself on its first T3 return and show the deceased's SIN. It also skips instalments and can pick a non calendar year end.
What does a graduated rate estate get that other trusts do not?
A GRE is taxed like an individual. Section 122(1) taxes every trust at the highest individual percentage on all its taxable income, and a graduated rate estate (with a qualified disability trust) is the exception laws-lois.justice.gc.ca. Once the 36 months run out, the same estate becomes an ordinary testamentary trust and loses every row below.
| Rule | Graduated rate estate | Testamentary trust after 36 months |
|---|---|---|
| Federal rate on income kept in the estate (2026) | 14% to 33%, individual brackets | 33% on every dollar |
| Tax year end | Any date up to 1 year after death | December 31 |
| Instalments | Not required | Required |
| Losses carried back to the final T1 (s.164(6)) | Yes, first three GRE years for deaths after August 11, 2024 | No |
| Gifts claimed on the deceased's last two T1 returns | Yes | Only as a former GRE, within 60 months of death |
| Personal trust status | Automatic | Not automatic |
| T3 type code | 903 | Not 903 |
The CRA confirms each of these in the 2025 T3 guide: since 2016 only a GRE is exempt from instalments, only a GRE automatically qualifies as a personal trust, and an estate that designated itself as a GRE uses trust type code 903 canada.ca. The year end and the 36 month cutoff are on the CRA estate deadlines page
canada.ca.
Which five conditions make an estate a graduated rate estate?
The definition is in s.248(1), and an estate is a GRE of an individual at a given time only if all five conditions hold at that time laws-lois.justice.gc.ca.
| Condition | What it means in practice |
|---|---|
| (a) No more than 36 months after the death | Status ends on the third anniversary of death, even if the estate is still being wound up |
| (b) The estate is a testamentary trust | If the estate stops meeting the testamentary trust definition, it stops being a GRE that day |
| (c) The deceased's SIN is on the T3 return | Required for the current year and every earlier year ending after 2015 |
| (d) The estate designates itself on its first T3 return | Miss the designation on the first return and the estate isn't a GRE |
| (e) No other estate designates for the same person | One GRE per individual, even when the will creates several estates or trusts |
The estate must be the one that arose on and as a consequence of the death. A trust the will sets up for a spouse or children isn't the estate itself, so it can't be the GRE. It pays the top rate on income it keeps unless it qualifies as a qualified disability trust.
How much tax does GRE status save on $100,000 of income?
Worked example: the estate keeps $100,000 of investment income in its 2026 tax year and pays none of it out to beneficiaries. As a GRE it uses the 2026 federal brackets: 14% up to $58,523 and 20.5% from there to $117,045 canada.ca.
| Calculation | Graduated rate estate | Trust at the top rate |
|---|---|---|
| First $58,523 | $58,523 × 14% = $8,193.22 | $58,523 × 33% |
| Next $41,477 | $41,477 × 20.5% = $8,502.79 | $41,477 × 33% |
| Federal tax | $16,696.01 | $33,000.00 |
| Average federal rate | 16.7% | 33% |
The federal saving is $16,303.99 for that year. Provincial tax comes on top and isn't included here. The dollar saving stops growing once income passes $258,482, because the GRE is then in the 33% bracket too.
One difference from an individual: the estate gets no basic personal amount. Section 122(1.1) blocks every personal credit for a trust except the donation credit (s.118.1), the pension credit (s.120.2) and the dividend tax credit (s.121), and that includes a GRE laws-lois.justice.gc.ca. Tax starts at the first dollar.
How does the 36 month clock set the T3 years?
The executor picks the end of the GRE's first tax year, any date up to one year after the death, and shows it on the first T3 return canada.ca. The estate has a deemed year end the day it stops being a GRE, no later than the end of the 36 month period, and later years are generally calendar years
canada.ca. If the year end isn't the anniversary of death, the CRA expects one more T3 for the stub between the third year end and the 36 month date
canada.ca.
Example: your client died March 15, 2025. Compare a December 31 year end with a March 15 year end.
| Year end chosen | GRE tax years | File and pay by |
|---|---|---|
| December 31 | Mar 16 to Dec 31, 2025 | March 31, 2026 |
| December 31 | Calendar 2026 | March 31, 2027 |
| December 31 | Calendar 2027 | March 30, 2028 |
| December 31 | Stub: Jan 1 to Mar 15, 2028 | June 13, 2028 |
| March 15 | Mar 16, 2025 to Mar 15, 2026 | June 15, 2026 (90th day is a Saturday) |
| March 15 | Mar 16, 2026 to Mar 15, 2027 | June 14, 2027 (90th day is a Sunday) |
| March 15 | Mar 16, 2027 to Mar 15, 2028 | June 13, 2028 |
The gotcha is the loss carryback. Section 164(6) lets the executor elect to carry the estate's net capital losses, and a terminal loss on the last property of a class, back to the deceased's final return, but only for losses in the first three tax years of the GRE laws-lois.justice.gc.ca. With a December 31 year end, the stub is a fourth year, so a loss realized between January 1 and March 15, 2028 stays in the estate. With a March 15 year end, all 36 months fall inside the three years.
The three year window applies when the death happened after August 11, 2024. For earlier deaths it's the first GRE year only, and either way the election requires an amended final return canada.ca. The deadlines for each return are on the T3 filing deadline page, and the capital losses usually come from the deemed disposition on death.
How do donations work for a graduated rate estate?
For deaths after 2015, a gift made by will is deemed made by the estate, at the time the property is transferred to the charity laws-lois.justice.gc.ca. A GRE can then allocate the gift to the estate year it was made, an earlier GRE year, or the deceased's final return and the return for the year before
canada.ca. On the final return the limit is 100% of net income, so the credit can absorb tax on the deemed disposition.
The window outlasts GRE status. An estate that still meets every GRE condition except the 36 month limit is a former GRE, and it keeps the same allocation choices for gifts made within 60 months after the death canada.ca. Section 118.1(5.1) also requires the gifted property to be property the estate acquired on and as a consequence of the death, or property substituted for it, unless the gift is one deemed made in respect of the death under s.118.1(5.2)
laws-lois.justice.gc.ca.
See the charitable donation tax credit for the credit rates, and donating securities for gifting listed shares from the estate.

Can a graduated rate estate claim the basic personal amount?
No. Section 122(1.1) lets a trust claim only the donation, pension and dividend tax credits, so a GRE pays tax from its first dollar of taxable income laws-lois.justice.gc.ca.
What happens to the estate after 36 months?
It becomes an ordinary testamentary trust: the flat top rate on retained income, December 31 year ends and instalments canada.ca. Before you distribute the remaining property, get a clearance certificate.
Does a GRE have to file a T3 every year under the trust reporting rules?
Not because of those rules alone. Section 150(1.2)(j) lists a graduated rate estate, or an estate that would be one if it had properly designated itself, among the trusts excluded from the rule that requires most express trusts to file laws-lois.justice.gc.ca. It still files when the ordinary T3 filing tests are met.
Is the GRE the same as the final T1 return?
No. The final T1 reports the deceased's income up to the date of death, and the GRE's T3 returns report income earned by the estate after death. See the final return for a deceased person and the rights or things return.
