How do I request an advance income tax ruling from the CRA, and what will it cost my client?
For 2026, an advance income tax ruling costs $306.50 an hour for work done from April 1, 2026 to March 31, 2027, with no deposit, and the CRA's target is 90 business days from a complete request. You file under IC70-6R12 with the facts, proposed transactions, purposes, rulings sought, a fee undertaking and publication consent.
What does an advance income tax ruling cost in 2026?
The CRA charges $306.50 for each hour or part hour of work done from April 1, 2026 to March 31, 2027. That's the $281.22 base fee with the annual CPI adjustment, and all fees are subject to applicable taxes canada.ca.
| Period the work is done | Base hourly fee | Hourly fee with CPI adjustment |
|---|---|---|
| April 1, 2026 to March 31, 2027 | $281.22 | $306.50 |
| April 1, 2025 to March 31, 2026 | $281.22 | $301.50 |
| April 1, 2024 to March 31, 2025 | $281.22 | $293.59 |
| April 1, 2023 to March 31, 2024 | $281.22 | No adjustment |
| April 1, 2022 to March 31, 2023 | $221.24 | No adjustment |
The $281.22 is the figure in section 2 of the Advance Income Tax Ruling Fees Order, which charges the fee "whether or not the request is withdrawn" laws-lois.justice.gc.ca. IC70-6R12 adds that no deposit is required for a ruling, and that time is billed even if the ruling comes back negative
canada.ca.
Invoices are payable in 30 days. Overdue amounts carry interest at the prescribed rate, and while your firm's account is overdue the Directorate stops work on the firm's other ruling requests canada.ca. One slow paying client can hold up every file you have in Ottawa.
A consultation before the request, on a new technical issue that is critical to how your client structures the deal, is billed at the same hourly rate and needs a $2,500 deposit payable to the Receiver General, refunded to the extent it exceeds the fee canada.ca.
What does a ruling cost when the file crosses April 1?
The rate follows the period the work is performed, not the date you filed canada.ca. The CRA doesn't publish an hours estimate, so the 40 hours below are an assumption to show the math. Say the Directorate spends 15 hours on your client's request in March 2026 and 25 hours in April 2026.
| Work | Hours | Rate | Fee |
|---|---|---|---|
| March 2026 | 15 | $301.50 | $4,522.50 |
| April 2026 | 25 | $306.50 | $7,662.50 |
| Total before tax | 40 | $12,185.00 | |
| If the ruling is 45 business days late: 8 April hours fall 1 to 30 days past the target (12.5% off) and 4 fall 31 to 60 days past it (25% off) | 12 | $11,572.00 |
The last row comes from the remission schedule in Appendix H of IC70-6R12. For requests received on or after April 1, 2021, the discount applies only to the rate on hours worked after the service target date, period by period: 12.5% for hours in the first 1 to 30 business days past the target, 25% for 31 to 60, 37.5% for 61 to 90 and 50% for 91 or more. No interest is paid on a remission canada.ca. So 8 × $306.50 × 12.5% = $306.50 and 4 × $306.50 × 25% = $306.50, a $613.00 reduction that leaves $11,572.00, plus GST/HST at the rate set by the recipient's address.
Time spent waiting for information you owe the CRA extends the target date canada.ca, so a late answer from your side can erase the remission.
Ruling or technical interpretation: which one does your client need?
A ruling confirms how the CRA applies the law to a definite transaction your client is planning. A technical interpretation is a generic statement of how the CRA reads a provision, and it doesn't settle your client's own situation canada.ca.
| Advance income tax ruling | Technical interpretation | |
|---|---|---|
| Covers | A specific proposed transaction | A provision, in general terms |
| Binding on the CRA | Yes, within its conditions | No |
| Fee | $306.50 an hour (2026 to 2027) | None |
| Service standard | 90 business days from a complete request | 90 business days from a complete request |
| On time in 2024 to 2025 | 91% | 56% (requests from taxpayers or representatives) |
| Priority | Handled first, in order received | Behind rulings |
Both standards run from the day the CRA has all the information it needs. The Directorate met the ruling target 91% of the time in 2024 to 2025 and 93% in 2023 to 2024, but met the interpretation target for taxpayers and representatives only 56% and 50% of the time canada.ca. If timing matters, the paid ruling is the faster route as well as the binding one.
What does a complete ruling request have to include?
Appendix A of IC70-6R12 sets the order. Part 1 holds the authorizations: the representative authorization (Appendix B), the fee undertaking (Appendix C or D), consent to publish the ruling in severed form (Appendix E), the email authorization (Appendix F) if you'll correspond by email, BEPS Action 5 information where it applies, and a Word copy of the request. Part 2 is the request itself: taxpayer information, confirmation that no similar issue is already before the CRA, definitions, facts, any completed transactions, the proposed transactions, purposes and the rulings requested. Part 3 adds information on every party, an analysis for each ruling requested and a GAAR analysis if section 245 might apply canada.ca.
The circular says the Directorate generally won't rule on issues already in a filed return under review, under objection or before the courts, on transactions that aren't seriously contemplated, on alternative courses of action, on fair market value, on unenacted legislation, or on questions that are mainly factual, such as residence canada.ca. A request with no fee undertaking or no publication consent won't be considered either.
Send it by email to [email protected] with the Appendix F authorization, or by mail to the Income Tax Rulings Directorate, 5th floor, Tower A, Place de Ville, 320 Queen Street, Ottawa ON K1A 0L5. Expect an acknowledgement with a file number within two weeks. If essential information is missing, you have 30 calendar days to supply it, or the file is closed and billed for the hours already worked canada.ca.
How binding is the ruling, and when can the CRA take it back?
The ruling binds the CRA for the taxpayer it was issued to and the transactions it describes, as long as nothing material was omitted or misstated and the transactions are carried out within the time limit in the ruling letter. You can ask for an extension before that limit expires, with reasons for the delay canada.ca.
It stops binding the CRA from the effective date of a legislative amendment that affects it, and for transactions after a court decision that conflicts with it. The CRA can also revoke a ruling issued in error or after a change in its interpretation, by written notice to the taxpayer or representative, and it isn't bound for transactions implemented after that notice canada.ca. The facts can still be audited after the transactions close.
There is no appeal process for a ruling canada.ca. An unfavourable ruling isn't a reassessment, so the notice of objection route opens only if the CRA later reassesses the completed transactions.
Rulings go to tax publishers in severed form. The circular warns that published rulings aren't updated for later changes in law or the CRA's position and may have material facts removed, so a severed ruling on a similar deal is a research lead, not protection for your client canada.ca.
Why the GAAR analysis needs more than IC70-6R12 asks for
The circular says the application of GAAR must be considered even when no GAAR ruling is requested, and its sample wording lets you ask the CRA to confirm that subsection 245(2) will not apply to the proposed transactions. The GAAR submission should follow the three step framework canada.ca.
IC70-6R12 is dated April 1, 2022 and is still the current version as of October 2026 canada.ca, so it predates the 2024 GAAR changes. Section 245 now treats a transaction as an avoidance transaction unless the tax benefit is reasonably not one of the main purposes, and makes a significant lack of economic substance an important sign of misuse or abuse
laws-lois.justice.gc.ca. Address both in the submission, including each factor in 245(4.2).
The 25% GAAR penalty in 245(5.1) applies only to a transaction that wasn't disclosed under section 237.3 or 237.4 laws-lois.justice.gc.ca. A ruling request is not that disclosure, so check whether the plan also needs a filing under the mandatory disclosure rules.

Can I get a ruling on a transaction my client has already done?
Usually not. Rulings are generally not issued on completed transactions, but the Directorate may consider one on completed or partially completed transactions if the request arrived before they were completed canada.ca.
Does the ruling cover provincial income tax?
Not the provincial allocation. Appendix A.2 of IC70-6R12 lists the provincial income tax implications of allocating income and expenses under the proposed transactions as something the ruling doesn't confirm canada.ca.
Is a GST/HST ruling requested the same way?
No. IC70-6R12 and its hourly fee cover income tax rulings from the Income Tax Rulings Directorate canada.ca. For the sales tax side, see GST/HST rulings.
What if my client pulls the request halfway through?
You can withdraw at any point, but the CRA still bills the time already spent on the request canada.ca, and the fees order charges the hourly fee whether or not the request is withdrawn
